GOJALAN PLATFORM TERMS OF USE Effective Date: 29 June 2026
- WELCOME TO GOJALAN GoJalan Mobility Solutions Sdn Bhd ("GoJalan", "we", "us" or "our"), is a company incorporated in Malaysia. We provide an online peer-to-peer car-sharing platform that connects car owners with drivers looking for rental services. The platform is accessible through gojalan.my and our mobile application. We are regulated by Agensi Pengangkutan Awam Darat (APAD), the Land Public Transport Agency of the Ministry of Transport Malaysia which has granted us permission to operate a peer-to-peer car sharing platform in Malaysia. GoJalan also is registered with Persatuan Insurans Am Malaysia (PIAM), the General Insurance Association of Malaysia, as an insurance agency that sells insurance products relevant to the rental of cars. As an insurance agency, our insurance policies are provided by insurers licensed by Bank Negara Malaysia.
GoJalan is committed to promoting a trusted, transparent and responsible vehicle sharing community where Hosts and Guests can transact with confidence. Unlike a conventional vehicle rental business, GoJalan does not own, lease or operate the vehicles listed on the Platform. GoJalan provides the digital infrastructure, booking technology, identity verification, payment facilitation, insurance distribution services and customer support that enable Hosts and Guests to enter into peer-to-peer vehicle sharing arrangements.
These Platform Terms of Use govern your access to and use of the GoJalan Platform and should be read together with:
• the Vehicle Owner (Host) Agreement;
• the Verified Driver (Guest) Agreement;
• the Host Protection Programme;
• the Driver Protection Plan;
• the Fees, Charges & Payment Schedule;
• the Claims & Incident Protocol;
• the Community Standards;
• the Privacy Notice; and
• any other policies published by GoJalan from time to time.
By accessing the and using the GoJalan platform, you are indicating your consent to the Agreement between you and GoJalan. If you do not agree to any of the Terms, you should not continue using the platform.
We may change the Services or update the Terms at our discretion occasionally, so it's important for you to check this page regularly. We will inform you if there are significant changes to the Services and/or the Terms through announcements on the GoJalan website, the GoJalan mobile application, or by sending an email to your registered email address. Your continued use or access to the Services after any changes will be considered as your acceptance of the updated Terms and modified Services. If you disagree with any of the revised Terms and/or the updated Services, you should refrain from using or accessing (or continuing to use or access) the Services.

OUR COMMITMENT GoJalan believes that successful peer-to-peer vehicle sharing depends on mutual trust, responsible conduct and fair treatment of all members of the community. Accordingly, GoJalan is committed to:
• maintaining a safe and trusted marketplace;
• promoting responsible vehicle sharing;
• protecting the interests of both Hosts and Guests;
• facilitating transparent and secure transactions;
• supporting efficient claims administration through participating insurers; and
• complying with applicable Malaysian laws and regulatory requirements.
Every member of the GoJalan community is expected to contribute to these objectives by acting honestly, respectfully and responsibly at all times. -
GOJALAN’S ROLE GoJalan operates solely as a digital marketplace facilitating peer-to-peer vehicle sharing between independent Vehicle Owners (Hosts) and Verified Drivers (Guests). Unless expressly stated otherwise:
GoJalan:
• does not own any Vehicle listed on the Platform;
• does not lease or rent Vehicles;
• is not a vehicle rental operator;
• is not a public transport provider;
• is not the employer, agent or representative of any Host or Guest (except in its capacity as an insurance agency for participating insurers);
• does not guarantee the conduct, performance or actions of any Platform user. Each Booking constitutes a separate agreement between the relevant Host and Guest, facilitated through the GoJalan Platform.
GoJalan’s responsibilities are limited to providing the Platform Services described in this Handbook. -
INSURANCE ARRANGEMENT Every eligible Booking completed through GoJalan is supported by mandatory Peer-to-Peer Motor Insurance.
Maintaining valid Peer-to-Peer Motor Insurance is a mandatory prerequisite for every Vehicle listed on the Platform.
GoJalan is not an insurance company, insurer, underwriter or takaful operator.
GoJalan acts solely as an insurance agency and authorised distribution channel for participating insurers licensed by Bank Negara Malaysia.
At the Effective Date of this Handbook, participating insurers include:
• Allianz General Insurance Company (Malaysia) Berhad;
• Etiqa General Insurance Berhad; or any other insurer licensed by Bank Negara Malaysia that GoJalan may appoint from time to time.
The applicable insurance policy is issued and underwritten solely by the participating insurer.
GoJalan does not:
• provide insurance coverage in its own capacity;
• underwrite insurance risks;
• approve or reject insurance claims; or
• determine insurance settlements.
Insurance protection remains subject to the applicable insurance policy, including its terms, exclusions, conditions, deductibles, excess amounts and coverage limits.
GoJalan may assist Hosts and Guests by facilitating communications, collecting supporting documents and coordinating the claims administration process. Any such assistance does not make GoJalan responsible for claim decisions or insurance outcomes.

ELIGIBILITY To use the Platform, every person must:
• be legally capable of entering into a binding contract under Malaysian law;
• satisfy GoJalan’s identity verification requirements;
• provide accurate, complete and up-to-date information;
• maintain a valid account in good standing; and
• comply with this Handbook and all applicable Malaysian laws.
GoJalan may refuse, suspend or terminate access to the Platform where reasonably necessary to protect the safety, integrity or proper operation of the Platform or to comply with legal or regulatory obligations. -
GOOD FAITH Every Vehicle Owner (Host), Verified Driver (Guest) and GoJalan agrees to exercise their respective rights and perform their obligations under this Handbook honestly, reasonably and in good faith.
Users must not misuse the Platform, exploit system weaknesses, provide false information or engage in conduct that may compromise the safety, integrity or reputation of the GoJalan community.
- FAIR DECISION-MAKING Where GoJalan is required to determine any dispute, reimbursement, administrative charge, policy breach or operational matter under this Handbook, GoJalan will assess the matter fairly, reasonably and in good faith based on the available evidence.
In reaching a determination, GoJalan may consider any relevant information, including:
• Booking records;
• photographs or videos uploaded through the Platform;
• GPS or telematics data (where available);
• communications exchanged through the Platform;
• statements from the Host and Guest;
• police reports;
• insurer findings;
• independent assessor reports; and
• any other relevant evidence.
GoJalan may request additional information from either party before making a determination.
- FEES, CHARGES & PAYMENTS The fees, charges, reimbursements, administrative charges and other amounts applicable to Hosts and Guests are set out in Schedule A – Fees, Charges & Payment Schedule, which forms part of this Handbook.
GoJalan may collect, process, distribute or deduct payments in accordance with this Handbook and the applicable Schedule.
Where permitted by law, GoJalan may offset any amount lawfully owed by a Host or Guest against any payment, reimbursement, refund or other amount otherwise payable to that user.

COMMUNITY STANDARDS All members of the GoJalan community are expected to:
• act honestly and respectfully;
• comply with Malaysian laws;
• protect the safety of others;
• maintain accurate information;
• cooperate with investigations;
• respect the property of other users; and
• refrain from fraudulent, abusive or unlawful conduct.
GoJalan may take proportionate enforcement measures where reasonably necessary to protect the Platform, its users or the public. Depending on the seriousness of the conduct, GoJalan may:
• issue a warning;
• require additional verification;
• temporarily suspend Platform access;
• restrict specific Platform functions;
• impose applicable administrative charges under this Handbook; or
• terminate a user’s account. -

LIMITATION OF LIABILITY 11.1 Mandatory Rights Nothing in this Handbook excludes or limits any liability, statutory guarantee, right or remedy that cannot lawfully be excluded or limited, including liability arising from fraud, fraudulent misrepresentation or wilful misconduct and any non-excludable rights under the Consumer Protection Act 1999.
11.2 Excluded Losses Subject to Clause 11.1 and to the fullest extent permitted by law, GoJalan and its Affiliates will not be liable, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, sales, business, opportunity, anticipated savings, agreements, contracts, goodwill, use, software, data or information arising out of or in connection with the Platform, Services, a Booking or a Trip. This exclusion applies only to the extent that the relevant category of loss may lawfully be excluded and does not restrict a consumer remedy that is mandatory under Malaysian law.
11.3 Vehicles and Insurance Claims Except for any verification expressly described in this Handbook, GoJalan does not independently inspect, certify, endorse or guarantee the safety, quality, legality, condition or roadworthiness of a Vehicle. Each Host is responsible for ensuring that every listed Vehicle continuously satisfies the Vehicle Eligibility Requirements and all applicable laws.
GoJalan does not guarantee that any claim made by a Host, Guest or other person under Peer-to-Peer Motor Insurance, a base policy, an SCDW plan or any other protection arrangement will be accepted or paid. Claim decisions remain subject to the applicable policy or plan terms and the determination of the relevant insurer or decision-maker.
11.4 Platform and Third-Party Disclaimer GoJalan operates a peer-to-peer vehicle sharing marketplace. GoJalan does not itself provide vehicle rental, vehicle sharing or insurance services in its own capacity and is not responsible for the acts or omissions of Hosts, Guests, Vehicle manufacturers, insurers, repairers, roadside-assistance providers, GPS or telematics providers, or other independent third parties.
Subject to Clause 11.1, the Platform and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, GoJalan disclaims warranties that are not expressly stated in this Handbook, including implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment and non-infringement.
GoJalan does not warrant that the Platform, any listing, User-Generated Content or third-party information will always be accurate, complete, current, uninterrupted, secure or error-free. GoJalan is not responsible for unauthorised access, malicious code, service interruption, content errors, loss of or damage to a Vehicle, personal injury, loss of life, property damage, or unlawful or objectionable third-party conduct except to the extent directly caused by GoJalan's breach of a non-excludable duty or other liability that cannot lawfully be limited.
11.5 Off-Platform Arrangements GoJalan and its Affiliates are not responsible for any booking, trip, extension, payment or other arrangement made between Users outside the GoJalan Platform, including a Booking initially made on the Platform but later extended, varied or paid for outside the Platform. Such arrangements may not benefit from Platform protections, insurance arrangements, SCDW plans, records or support.
11.6 Maximum Aggregate Liability
Subject to Clause 11.1 and to the fullest extent permitted by law, the total aggregate liability of GoJalan and its Affiliates to a User arising out of or in connection with this Handbook, the Platform, the Services, any Booking or any Trip will not exceed the greater of:
• the total fees paid by or retained from that User by GoJalan during the twelve (12) months immediately preceding the event giving rise to the claim; or
• RM1,000.
Where the User is a consumer under the Consumer Protection Act 1999, this cap applies only to the extent that it is lawful and fair. A User may not recover more than once for the same loss, and any insurance proceeds or compensation received for that same loss may be taken into account to the extent permitted by law.
11.7 User Indemnity
To the fullest extent permitted by Malaysian law, each User agrees to defend, indemnify and hold harmless GoJalan and its Affiliates from third-party claims, liabilities, damages, losses, costs and reasonable legal fees to the extent arising directly from:
• the User's breach of this Handbook or applicable law;
• the User's User-Generated Content;
• the User's interaction with another User;
• the User's Booking, Trip or Vehicle listing; or
• the User's negligent, unlawful, fraudulent or wilful act or omission in connection with a Vehicle or the Platform.
11.8 Complaints and Prompt Notice A User should notify GoJalan of a complaint within thirty (30) days after becoming aware of the relevant incident so that it can be investigated promptly. A delay does not extinguish any statutory or legal right that cannot lawfully be excluded, but GoJalan will not be responsible, to the extent permitted by law, for additional loss caused by an unreasonable delay in notification.
11.9 Survival This Limitation of Liability section survives the suspension or termination of an Account and the completion, cancellation or termination of a Booking or Trip. GOJALAN VEHICLE OWNER (HOST) AGREEMENT This Vehicle Owner (Host) Agreement ("Host Agreement") forms part of the GoJalan Legal Handbook and governs the rights, responsibilities and obligations of every Vehicle Owner ("Host") who lists or shares a Vehicle through the GoJalan Platform. This Host Agreement should be read together with the GoJalan Platform Terms of Use, the GoJalan Legal Handbook, Schedule A – Fees, Charges & Payment Schedule and any other applicable schedules or policies published by GoJalan from time to time.
By registering as a Host, listing a Vehicle, accepting a Booking or otherwise using the GoJalan Platform as a Host, you acknowledge that you have read, understood and agree to be bound by this Host Agreement.
PART I – JOINING GOJALAN
- Welcome to the GoJalan Community Thank you for choosing GoJalan. At GoJalan, we believe every privately owned Vehicle has the potential to create value. By sharing your Vehicle through the GoJalan Platform, you become part of a growing community of Vehicle Owners (Hosts) who are helping to make mobility more accessible while earning additional income from Vehicles that may otherwise remain underutilised.
Whether you are sharing a single Vehicle or managing multiple Vehicles, GoJalan is committed to making peer-to-peer vehicle sharing simple, secure and rewarding.
1.1 Our Commitment to Hosts GoJalan is committed to providing a trusted marketplace that enables Hosts to share their Vehicles with confidence.
Through the GoJalan Platform, we strive to support every eligible Booking by providing:
• identity and driving licence verification for Verified Drivers (Guests);
• secure booking management and payment processing;
• access to Peer-to-Peer Motor Insurance arrangements for eligible Vehicles;
• claims administration support;
• customer support services;
• trust and safety initiatives; and
• technology and operational tools designed to simplify the vehicle sharing experience.
While no vehicle sharing platform can eliminate every risk, GoJalan is committed to continually improving the Platform, strengthening our community and providing Hosts with the tools and support needed to share their Vehicles responsibly and confidently.
1.2 About GoJalan GoJalan Mobility Solutions Sdn. Bhd. (Company Registration No. 202601022365 (1684462-M)) operates the GoJalan Platform, a technology-enabled peer-to-peer vehicle sharing marketplace that connects independent Vehicle Owners (Hosts) with Verified Drivers (Guests).
Each Vehicle listed on the GoJalan Platform remains independently owned and controlled by the respective Vehicle Owner (Host).
GoJalan facilitates Bookings by providing a secure technology platform together with supporting services, including:
• Host and Guest account verification;
• booking management;
• secure payment processing;
• access to Peer-to-Peer Motor Insurance arrangements through participating insurers licensed by Bank Negara Malaysia;
• claims administration support;
• customer support services; and
• trust and safety measures.
GoJalan also acts as an insurance agency for participating insurers in relation to Peer-to-Peer Motor Insurance products made available through the GoJalan Platform.
Our goal is to build a trusted and transparent vehicle sharing community where Hosts can confidently earn from their Vehicles while Guests enjoy safe and reliable access to transportation.

Becoming a Vehicle Owner (Host) 2.1 Host Eligibility Before a User may list a Vehicle on the GoJalan Platform, the User must first register a GoJalan Account and be approved by GoJalan as a Vehicle Owner ("Host"). To become an approved Host, the User must satisfy GoJalan's onboarding and verification requirements, including the following: (a) Minimum Age The User must be at least twenty-one (21) years of age and have the legal capacity to enter into a binding contract under the laws of Malaysia. (b) GoJalan Account The User must register a GoJalan Account using a valid email address and password or, where made available by GoJalan, an approved third-party or social-network login method. The User is responsible for ensuring that all account information remains accurate, complete and up to date throughout the period of using the GoJalan Platform. (c) Identity Verification The User shall provide such information and supporting documents as GoJalan may reasonably require for identity verification and regulatory compliance, including where applicable:
• a valid MyKad (NRIC), passport or other government-issued identification document;
• valid banking details for the receipt of Host earnings, where the account holder's name corresponds with the registered Host; and
• any other information or documents reasonably requested by GoJalan from time to time. (d) Vehicle Verification Before a Vehicle may be listed on the GoJalan Platform, the Host shall provide information and documentation reasonably required by GoJalan to verify the Vehicle, including where applicable:
• the Vehicle registration certificate or ownership documents;
• a valid road tax issued by JPJ;
• A valid car grant;
• evidence of the applicable Peer-to-Peer Motor Insurance or such other insurance documentation accepted by GoJalan;
• the latest inspection, servicing or maintenance records where requested by GoJalan; and
• any additional information or documents reasonably required to verify the Vehicle's eligibility.
All information and documents submitted must be true, accurate, complete and satisfactory to GoJalan. (e) Verification & Background Checks The Host authorises GoJalan to conduct such verification, screening and background checks as GoJalan reasonably considers necessary for the purposes of onboarding, fraud prevention, safety, regulatory compliance and the operation of the GoJalan Platform. Such verification may be carried out by GoJalan or by authorised third-party service providers acting on GoJalan's behalf . Approval as a Vehicle Owner (Host) is subject to GoJalan's successful completion of its onboarding and verification requirements. GoJalan may approve or decline a Host application based on its onboarding, safety, insurance, legal and operational requirements. GoJalan may update those requirements from time to time and will exercise its discretion reasonably, in good faith and in accordance with applicable law. 2.2 Continuing Eligibility A Host shall continue to satisfy the applicable eligibility requirements throughout the period of using the GoJalan Platform. The Host shall promptly notify GoJalan if:
• ownership or lawful possession of the listed Vehicle changes;
• any information previously provided to GoJalan becomes inaccurate or incomplete;
• the Vehicle no longer satisfies GoJalan's listing requirements; or
• any circumstance arises that may materially affect the Host's ability to fulfil this Host Agreement.
GoJalan may suspend or withdraw a Host's approval where the Host no longer satisfies the applicable eligibility requirements or where GoJalan reasonably considers such action necessary to protect the safety, integrity or operation of the GoJalan Platform. -
Listing Your Vehicle Every Vehicle listed on the GoJalan Platform represents both the Host and the wider GoJalan community.
To provide Guests with a safe, reliable and enjoyable vehicle sharing experience, every Host is responsible for ensuring that each listed Vehicle:
• is duly registered to the Host, or the Host has lawful possession of and authority to share the Vehicle;
• is registered and authorised for use on public roads in Malaysia;
• is safely maintained, roadworthy and serviced in accordance with applicable law and the manufacturer's recommendations;
• is not subject to any unresolved manufacturer or regulatory safety recall;
• is not partially or fully wrapped in vinyl wrap film;
• has not been classified as beyond economic repair (BER) in an insurer's quotation, assessment or other relevant insurance record;
• is accurately described and remains in the condition represented on the GoJalan Platform; and
• is insured with a participating Peer-to-Peer Motor Insurer through GoJalan before it is made available for sharing.
The Host shall ensure that all photographs, descriptions, specifications and information published on the GoJalan Platform accurately represent the Vehicle.
GoJalan may request additional information, photographs or documentation where reasonably necessary to verify the Vehicle's condition, ownership or eligibility.
Where a listed Vehicle no longer satisfies this Host Agreement, applicable laws or GoJalan's operational standards, GoJalan may suspend or remove the Vehicle listing until the relevant requirements have been satisfied.
PART II – EARNING THROUGH GOJALAN 4. Earning Through GoJalan Sharing your Vehicle through the GoJalan Platform allows you to generate additional income whenever your Vehicle is successfully booked by a Verified Driver (Guest). GoJalan is committed to providing a transparent and reliable payment process so that Hosts can focus on sharing their Vehicles with confidence while we facilitate Bookings, payment collection and payout administration.
The amount you earn from each completed Booking depends on factors including the Booking fee set for your Vehicle, the duration of the Booking and any applicable adjustments made in accordance with this Host Agreement.
4.1 Booking fee As the Vehicle Owner (Host), you may determine the Booking fee for your Vehicle, subject to any pricing tools, promotional programmes or reasonable pricing parameters introduced by GoJalan from time to time.
The applicable Booking fee will be displayed on the GoJalan Platform before a Booking is confirmed.
Once a Booking has been confirmed, the applicable Booking fee shall form part of the Booking and shall not be amended unless otherwise permitted through the GoJalan Platform.
4.2 Host Earnings
For every successfully completed Booking, the Host will be entitled to receive the applicable Host Earnings after:
• any Marketplace Fee;
• approved refunds or adjustments;
• applicable deductions authorised under this Host Agreement; and
• any other amounts properly payable in accordance with this Host Agreement or Schedule A – Fees, Charges & Payment Schedule.
The calculation of Host Earnings will be made available through the GoJalan Platform.
4.3 Marketplace Fee GoJalan charges a Marketplace Fee for facilitating Bookings and providing services through the GoJalan Platform.
The Marketplace Fee contributes towards the operation and continuous improvement of the Platform, including:
• secure booking and payment processing;
• customer support services;
• platform technology and maintenance;
• trust and safety initiatives;
• claims administration support;
• operational support services; and
• other services made available to Hosts and Guests from time to time.
The applicable Marketplace Fee is set out in Schedule A – Fees, Charges & Payment Schedule, which forms part of this Host Agreement.
4.4 Host Payouts GoJalan will arrange payment of the Host Earnings to the Host's nominated bank account after the successful completion of the Booking and any applicable verification, adjustment or claims review processes.
Payouts will be made in accordance with GoJalan's prevailing payout schedule. Where a payout is delayed due to an ongoing investigation, dispute, chargeback, claims process or regulatory requirement, GoJalan will process the payout as soon as reasonably practicable after the relevant matter has been resolved.
4.5 Taxes The Host is solely responsible for determining and fulfilling any tax obligations arising from income earned through the GoJalan Platform.
Where required by applicable law, GoJalan may collect, withhold, report or disclose information relating to Host Earnings to the relevant authorities.
4.6 Earnings Summary The GoJalan Platform may provide Hosts with access to Booking history, earnings summaries, payout records and other financial information for reference purposes. Hosts are encouraged to review their earnings records regularly and notify GoJalan promptly of any discrepancies.
4.7 Transparency of Payments GoJalan is committed to providing a transparent payment experience for every Host. The GoJalan Platform will display the relevant Booking details, applicable Host Earnings and any deductions relating to a completed Booking, enabling the Host to understand how the final payout has been calculated.
Where a Host has any questions regarding a payout or deduction, the Host may contact GoJalan's customer support for assistance.
PART III – GOJALAN HOST PROTECTION & VEHICLE RESPONSIBILITY 5. GoJalan Host Protection Programme The GoJalan Host Protection Programme is designed to support Vehicle Owners (Hosts) by providing the tools, services and operational support needed to facilitate safer, more transparent and rewarding peer-to-peer vehicle sharing. While every Booking is unique, GoJalan is committed to supporting Hosts throughout the vehicle sharing journey by providing a trusted marketplace and facilitating eligible Bookings through the GoJalan Platform.
5.1 What the GoJalan Host Protection Programme Includes
Depending on the nature of the Booking and the services available on the GoJalan Platform, the GoJalan Host Protection Programme may include:
• identity verification of Vehicle Owners (Hosts) and Verified Drivers (Guests);
• driving licence verification of Guests;
• secure booking management and payment processing;
• access to Peer-to-Peer Motor Insurance arrangements through participating insurers licensed by Bank Negara Malaysia;
• claims administration support;
• customer support services;
• trust and safety initiatives;
• digital Booking and Trip records;
• pre-trip and post-trip Vehicle inspection records; and
• other operational tools and services introduced by GoJalan from time to time.
The GoJalan Host Protection Programme supports the vehicle sharing experience but is not an insurance policy.\
- Protecting Your Vehicle Protecting your Vehicle begins with ensuring that it is properly insured, responsibly shared and maintained in a safe and roadworthy condition throughout every Booking.
6.1 Peer-to-Peer Motor Insurance
Every Vehicle listed on the GoJalan Platform must be covered under a Peer-to-Peer Motor Insurance policy arranged through GoJalan with a participating insurer licensed by Bank Negara Malaysia.
The participating insurer may include:
• Allianz General Insurance Company (Malaysia) Berhad;
• Etiqa General Insurance Berhad; or
• any other insurer approved by GoJalan and licensed by Bank Negara Malaysia.
The applicable Peer-to-Peer Motor Insurance is intended to provide protection for eligible Bookings, subject to the applicable insurance policy issued by the participating insurer.
6.2 Migration to the Participating Peer-to-Peer Motor Insurer To ensure that every Booking is supported by the appropriate Peer-to-Peer Motor Insurance arrangements, every listed Vehicle is required to maintain its base motor insurance policy with the participating Peer-to-Peer Motor Insurer arranged through GoJalan.
Where the Vehicle is already insured under another motor insurance policy at the time it is listed on the GoJalan Platform, the Host shall migrate the Vehicle's base policy to the participating Peer-to-Peer Motor Insurer through GoJalan.
If the existing policy is not immediately due for renewal, the migration shall be completed upon the next renewal of the existing policy or within three (3) months from the date the Vehicle is first listed on the GoJalan Platform, whichever occurs earlier ("Grace Period").
During the Grace Period, the Vehicle may continue to be listed on the GoJalan Platform, subject to GoJalan's onboarding requirements.
Hosts are encouraged to complete the migration as early as reasonably practicable to minimise any interruption to the intended protection arrangements available through the GoJalan Platform.
The Grace Period is provided solely to facilitate the orderly transition of the Vehicle's insurance arrangements.
The Host acknowledges and agrees that any incident giving rise to a claim during the Grace Period shall be subject to the Host's existing insurance arrangements. Accordingly, GoJalan and its Affiliates shall not be liable for any claim, proceeding, liability, obligation, loss, damage, cost or expense arising from or in connection with any incident occurring during the Grace Period to the extent that such claim or loss relates to the Vehicle not yet being covered under the participating Peer-to-Peer Motor Insurance.
If the Host fails to complete the required migration immediately upon expiry of the Grace Period, GoJalan may suspend or remove the Vehicle listing until the applicable Peer-to-Peer Motor Insurance has been successfully arranged through GoJalan. GoJalan shall not be liable for any loss of income, business opportunity or other loss arising from such suspension or removal.
6.3 Verification Before Vehicle Handover To help protect the Host, support the applicable Peer-to-Peer Motor Insurance arrangements and promote the safe use of Vehicles on the GoJalan Platform, the Host shall verify the identity and driving eligibility of the Verified Driver (Guest) before releasing the Vehicle for each Booking.
While GoJalan conducts identity and driving licence verification during the Guest onboarding process, the Host remains responsible for carrying out a final verification at the point of Vehicle handover to ensure that the person collecting the Vehicle is the same Verified Driver (Guest) shown in the confirmed Booking.
Before handing over the Vehicle, the Host shall confirm that the Verified Driver (Guest):
• is the individual named in the confirmed Booking;
• presents a valid and current driving licence recognised under Malaysian law, including a valid Malaysian driving licence or a valid international driving permit or licence recognised for driving in Malaysia; and
• satisfies any additional verification requirements communicated by GoJalan from time to time.
Where reasonably requested by GoJalan or the participating insurer, the Host shall retain or upload evidence that the required verification has been completed.
Completing these verification steps supports a smoother claims process and helps preserve the protection available under the applicable Peer-to-Peer Motor Insurance.
Failure to complete the required verification may affect the Host's eligibility to claim where required under the applicable insurance policy.
6.4 Claims for Vehicle Damage Where a Vehicle suffers physical loss or damage arising from an eligible Booking, the Host shall submit the claim through the claims process made available by GoJalan or the participating insurer.
GoJalan may provide reasonable administrative assistance by facilitating claim submissions, coordinating communications and supporting the exchange of relevant information between the Host and the participating insurer.
The assessment, acceptance and settlement of every insurance claim remain solely the responsibility of the participating insurer in accordance with the applicable insurance policy.
For the avoidance of doubt, the Host shall not seek recovery directly from the Verified Driver (Guest) for any loss or damage intended to be covered under the applicable Peer-to-Peer Motor Insurance unless otherwise permitted under the applicable insurance policy or by law.
6.5 Insurance Policy The applicable insurance policy issued by the participating insurer governs all matters relating to insurance coverage, including claim eligibility, policy conditions, exclusions, repair procedures and claim assessment requirements.
Hosts are encouraged to read and understand the applicable insurance policy before making their Vehicle available for sharing.
Nothing in this Host Agreement amends, replaces or overrides the applicable insurance policy.
6.6 Personal Property & Normal Wear and Tear Hosts are encouraged to remove personal belongings from the Vehicle before each Booking.
Unless expressly covered under the applicable insurance policy, neither GoJalan nor the participating insurer is responsible for the loss of or damage to personal property left inside the Vehicle, including removable accessories or aftermarket equipment.
Minor cosmetic deterioration and ordinary wear and tear arising from normal use of the Vehicle are expected in peer-to-peer vehicle sharing and are generally not recoverable unless otherwise provided under the applicable insurance policy.
6.7 Repairs To facilitate efficient repairs and insurance claims, GoJalan strongly recommends that repairs be carried out at the participating insurer's authorised panel workshops. Where repairs are carried out at an authorised panel workshop, the workshop will liaise directly with the Vehicle Owner (Host) regarding the documents, approvals and information required to facilitate the repair and insurance claim.
A Host may choose to have the Vehicle repaired at another repair facility. However, the Host shall be responsible for any additional costs, charges or expenses that are not approved or covered by the participating insurer under the applicable insurance policy.
6.8 Claims Outside the Peer-to-Peer Motor Insurance Where a claim falls outside the applicable Peer-to-Peer Motor Insurance, GoJalan may, where reasonably practicable, provide administrative assistance to the Host. Any assistance provided by GoJalan is voluntary and does not create any obligation on GoJalan to manage, pursue or resolve the claim.
The Host remains responsible for submitting and managing any claim that falls outside the applicable Peer-to-Peer Motor Insurance arrangements.
GoJalan shall not be liable for any loss, damage, expense or unsuccessful claim arising from the Host's failure to submit or pursue such claim.
PART IV – BOOKING MANAGEMENT & VEHICLE SHARING 7. Managing Your Bookings Every Booking is an opportunity to earn income while contributing to a trusted and reliable vehicle sharing community.
GoJalan provides the technology and operational tools to facilitate Bookings from reservation through to Vehicle return. Hosts are encouraged to manage their Bookings responsibly to provide a positive experience for Verified Drivers (Guests) and to support the integrity of the GoJalan Platform.
7.1 Booking Requests Where a Vehicle is available for Booking, the Host may receive Booking requests through the GoJalan Platform.
Each Booking request will contain the relevant information required for the Host to decide whether to proceed with the Booking, including the proposed Booking period and the identity of the Verified Driver (Guest).
Hosts are encouraged to review each Booking request carefully before accepting it.
7.2 Booking Confirmation A Booking is confirmed once it has been accepted through the GoJalan Platform or automatically confirmed through any Instant Booking feature made available by GoJalan.
Once confirmed, both the Host and the Verified Driver (Guest) are expected to honour the Booking and comply with their respective obligations under the GoJalan Legal Handbook.
Where the Host is unable to fulfil a confirmed Booking due to unforeseen circumstances, the Host should notify GoJalan as soon as reasonably practicable.
7.3 Preparing Your Vehicle A well-prepared Vehicle contributes to a safe, reliable and enjoyable vehicle sharing experience for both the Host and the Verified Driver (Guest).
Before accepting a Booking, the Host shall ensure that the Vehicle is equipped with a Global Positioning System (GPS) tracking device or such other vehicle tracking technology.
The Host shall ensure that the Approved Tracking Device is properly installed, fully operational and remains activated throughout the Booking.
The Approved Tracking Device helps support vehicle security, Trip management, recovery assistance where required, and the efficient administration of Bookings, incidents and claims.
Where a Vehicle is not equipped with an operational Approved Tracking Device, GoJalan may suspend or restrict the Vehicle from accepting Bookings until the requirement has been satisfied.
Before handing over the Vehicle, the Host shall also ensure that the Vehicle:
• is safe, clean and roadworthy;
• contains sufficient fuel or battery charge, where applicable, in accordance with the Booking details;
• is free from any condition that may affect its safe operation;
• contains all documents, equipment and accessories reasonably required for the Booking; and
• is presented substantially in the condition described on the GoJalan Platform.
The Host is encouraged to upload clear photographs of the Vehicle immediately before handover to accurately record its condition at the commencement of the Booking.
7.4 Vehicle Handover
Vehicle handover should take place at the agreed location and time reflected in the confirmed Booking.
Before releasing the Vehicle, the Host shall:
• complete the verification requirements under Clause 6.3;
• verify the Vehicle's condition;
• record any existing damage or abnormalities through the GoJalan Platform; and
• hand over all keys, access devices and equipment intended to be provided for the Booking.
The Host and the Verified Driver (Guest) are encouraged to complete the pre-trip inspection through the GoJalan Platform to help establish the Vehicle's condition at the start of the Booking.
7.5 During the Booking During the Booking, the Verified Driver (Guest) is responsible for the care and lawful use of the Vehicle in accordance with the Guest Agreement. If the Host becomes aware of any incident that may affect the safety of the Vehicle, the Booking or the GoJalan Platform, the Host should notify GoJalan promptly. The Host shall not interfere with or interrupt a Booking except where reasonably necessary for safety, legal compliance or as otherwise permitted under this Host Agreement.
7.6 Vehicle Return
Upon completion of the Booking, the Host should inspect the Vehicle as soon as reasonably practicable.
The Host is encouraged to:
• compare the Vehicle against the pre-trip inspection records;
• upload photographs of the Vehicle immediately after its return;
• report any damage, missing items or abnormalities through the GoJalan Platform without undue delay; and
• cooperate with GoJalan and the participating insurer during any subsequent investigation or claims process.
Prompt reporting helps facilitate a fair and efficient assessment of any claim arising from the Booking.
7.7 Host Cancellations GoJalan understands that unforeseen circumstances may occasionally prevent a Host from fulfilling a confirmed Booking. Where this occurs, the Host shall notify the Verified Driver (Guest) and GoJalan as soon as reasonably practicable through the GoJalan Platform.
Where a Host cancels a confirmed Booking, GoJalan will administer any applicable refund to the Verified Driver (Guest) in accordance with the applicable cancellation policy and Schedule A – Fees, Charges & Payment Schedule.
Host cancellation charges, where applicable, shall be determined in accordance with Schedule A – Fees, Charges & Payment Schedule.
Hosts are expected to honour all confirmed Bookings. Repeated, avoidable or unreasonable cancellations may adversely affect the reliability of the GoJalan Platform and the experience of Verified Drivers (Guests).
Accordingly, GoJalan may take one or more of the following actions where reasonably necessary:
• impose the applicable Host cancellation charges set out in Schedule A – Fees, Charges & Payment Schedule;
• suspend or remove the affected Vehicle listing;
• suspend the Host's Account; or
• terminate the Host's Account in cases of serious or repeated non-compliance.
In determining the appropriate action, GoJalan may consider all relevant circumstances, including:
• whether the cancellation arose from factors beyond the Host's reasonable control;
• the Host's cancellation history;
• the impact of the cancellation on the Verified Driver (Guest) and the GoJalan Platform; and
• any other relevant circumstances that GoJalan reasonably considers appropriate.
Nothing in this Clause limits GoJalan's right to take immediate action where reasonably necessary to protect the safety, integrity or operation of the GoJalan Platform.
7.8 Guest No-Show Where a Verified Driver (Guest) does not arrive to collect the Vehicle within the period specified in GoJalan's operational policies, the Host should promptly report the no-show through the GoJalan Platform.
Failure to report a Guest no-show within the required timeframe may affect the Host's entitlement to any applicable payment or compensation.
The applicable arrangements relating to Guest no-shows are set out in Schedule A – Fees, Charges & Payment Schedule.
PART V – INCIDENTS, COMMUNICATION & DISPUTE MANAGEMENT 8. Communication During a Booking Open and timely communication contributes to a safe, reliable and positive vehicle sharing experience.
Where reasonably practicable, Hosts are encouraged to communicate with Verified Drivers (Guests) through the GoJalan Platform to facilitate Bookings and maintain an accurate record of communications.
Where communication takes place outside the GoJalan Platform, GoJalan may have limited ability to assist in resolving any dispute arising from such communications.
8.1 Reporting Incidents If the Host becomes aware of any accident, damage, theft, loss, breakdown, misuse of the Vehicle or any other incident that may affect the Booking, the Host shall notify GoJalan as soon as reasonably practicable.
The Host shall provide such information, photographs and supporting documents as GoJalan or the participating insurer may reasonably request to facilitate the administration of the incident or any related claim.
Prompt reporting helps protect the interests of the Host, the Verified Driver (Guest) and the efficient administration of any applicable insurance claim.
8.2 Cooperation To facilitate the efficient resolution of Bookings, incidents and claims, the Host agrees to cooperate with GoJalan, the participating insurer and any relevant authority where reasonably required.
Such cooperation may include:
• providing information and supporting documents;
• responding to reasonable enquiries;
• making the Vehicle available for inspection where required;
• assisting with investigations relating to a Booking or claim; and
• taking reasonable steps to minimise further loss or damage.\
8.3 Dispute Resolution GoJalan is committed to resolving disputes fairly, promptly and transparently. Where a dispute arises between a Host and a Verified Driver (Guest), the parties are encouraged to first seek an amicable resolution through the GoJalan Platform.
Where the dispute cannot be resolved directly, GoJalan may facilitate communications and review the information provided by the parties to assist in resolving the matter.
The Host acknowledges that GoJalan may make operational decisions relating to the administration of the Platform based on the information available at the time. Such decisions do not determine the legal rights of the parties or the outcome of any insurance claim.
8.4 Records The Host shall retain all records reasonably relating to a Booking, including photographs, inspection records and other supporting documents, for such period as GoJalan may reasonably require for the administration of claims, disputes or regulatory obligations.
Where reasonably requested, the Host shall provide copies of such records to GoJalan or the participating insurer.
PART VI – PLATFORM ADMINISTRATION & GENERAL PROVISIONS 9. Host Charges GoJalan is committed to maintaining a fair, transparent and trusted marketplace for all users.
Most Bookings are completed without any additional charges. However, where charges arise as a result of the Host's actions, omissions or failure to comply with this Host Agreement, the applicable charges shall be determined in accordance with Schedule A – Fees, Charges & Payment Schedule.
GoJalan may deduct any amounts properly due and payable by the Host from the Host's earnings or any other amounts payable to the Host, subject to applicable law.

Suspension & Removal of Listings GoJalan may suspend or remove a Vehicle listing, restrict access to the GoJalan Platform or suspend a Host Account where reasonably necessary to:
• protect the safety of users;
• maintain the integrity or security of the GoJalan Platform;
• investigate suspected fraud, misuse or unlawful activities;
• comply with applicable laws, regulatory requirements or directions issued by a competent authority; or
• address a material breach of this Host Agreement.
Where reasonably practicable, GoJalan will notify the Host of the reasons for the suspension or removal and, where appropriate, provide the Host with an opportunity to rectify the relevant issue. Nothing in this Clause limits GoJalan's right to take immediate action where it reasonably considers such action necessary to protect users, the GoJalan Platform or the public. -
Privacy & Personal Data GoJalan respects the privacy of its users and is committed to protecting personal data in accordance with applicable Malaysian laws.
The Host acknowledges that GoJalan may collect, use, store, disclose and process personal data for purposes including:
• account registration and verification;
• Booking administration;
• payment processing;
• customer support;
• fraud prevention;
• trust and safety;
• claims administration;
• legal and regulatory compliance; and
• the operation, maintenance and improvement of the GoJalan Platform.
The collection, use, disclosure and processing of personal data shall be governed by GoJalan's Privacy Notice.
- GoJalan's Role
GoJalan operates and manages a technology-enabled marketplace that connects independent Vehicle Owners (Hosts) with Verified Drivers (Guests).
In facilitating Bookings, GoJalan may provide services including:
• account registration and verification;
• Booking management;
• secure payment processing;
• access to Peer-to-Peer Motor Insurance arrangements through participating insurers;
• claims administration support;
• customer support services;
• trust and safety initiatives; and
• other Platform services introduced from time to time.
Each Vehicle listed on the GoJalan Platform remains independently owned, maintained and controlled by the respective Vehicle Owner (Host).
Except as expressly provided under this Host Agreement, GoJalan is not a party to the vehicle sharing arrangement between the Host and the Verified Driver (Guest). Nothing in this Host Agreement excludes or limits any liability that cannot lawfully be excluded or limited under the laws of Malaysia.
- Amendments GoJalan may amend this Host Agreement, the GoJalan Legal Handbook or any applicable Platform policies from time to time.
Where a material amendment is made, GoJalan will provide reasonable notice through the GoJalan Platform or by any other appropriate means.
The Host's continued use of the GoJalan Platform after the effective date of the amendment constitutes acceptance of the revised terms.
- Governing Law & Dispute Resolution This Host Agreement shall be governed by and construed in accordance with the laws of Malaysia.
The Host and GoJalan shall endeavour to resolve any dispute arising out of or in connection with this Host Agreement through good faith discussions.
Where the dispute cannot be resolved amicably, either party may refer the dispute to the courts of Malaysia, which shall have exclusive jurisdiction unless otherwise required by applicable law.
- General Provisions If any provision of this Host Agreement is held to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect.
No failure or delay by GoJalan in exercising any right or remedy under this Host Agreement shall constitute a waiver of that right or remedy.
This Host Agreement shall be read together with the GoJalan Platform Terms of Use, the GoJalan Legal Handbook, Schedule A – Fees, Charges & Payment Schedule and any other applicable schedules or policies published by GoJalan from time to time, all of which form part of the contractual relationship between GoJalan and the Host.
- Host Acknowledgement By registering as a Vehicle Owner (Host), listing a Vehicle, accepting a Booking or otherwise using the GoJalan Platform, the Host acknowledges and agrees that: (a) the Host has read, understood and agrees to be bound by this Host Agreement; (b) the Host agrees to comply with the GoJalan Legal Handbook and all applicable GoJalan policies; (c) the Host understands the rights, responsibilities and obligations associated with sharing a Vehicle through the GoJalan Platform; (d) the Host understands that the applicable Peer-to-Peer Motor Insurance is issued and underwritten by the participating insurer, and that GoJalan acts as an insurance agency in relation to such insurance products; (e) the Host acknowledges that the GoJalan Host Protection Programme is intended to support the vehicle sharing experience and is not an insurance policy; and (f) the Host agrees to cooperate with GoJalan and the participating insurer in relation to any Booking, incident or claim arising through the GoJalan Platform.
GOJALAN VERIFIED DRIVER (GUEST) AGREEMENT This Verified Driver (Guest) Agreement ("Guest Agreement") forms part of the GoJalan Legal Handbook and governs the rights, responsibilities and obligations of every Verified Driver ("Guest") who registers, books or operates a Vehicle through the GoJalan Platform.
By creating a GoJalan Account, completing the verification process, making a Booking or using a Vehicle through the Platform, you acknowledge that you have read, understood and agree to be bound by this Guest Agreement, the GoJalan Platform Terms of Use, the applicable Schedules and all other documents forming part of the GoJalan Legal Handbook.
PART I – JOINING GOJALAN
- Welcome to the GoJalan Community Welcome to GoJalan. GoJalan provides a trusted peer-to-peer vehicle sharing marketplace that connects Vehicle Owners ("Hosts") with Verified Drivers ("Guests") through a secure digital platform.
Every Vehicle available on the Platform is privately owned by an independent Host. As a Guest, you are entrusted with another person's Vehicle and are expected to exercise the same degree of care, responsibility and respect that you would apply to your own property.
GoJalan is committed to providing a safe, transparent and reliable vehicle sharing experience by facilitating secure bookings, identity verification, payment processing, mandatory Peer-to-Peer Motor Insurance arrangements and customer support.
- Guest Eligibility
2.1 Becoming a Verified Driver (Guest)
Before a User may book, access or operate any Vehicle through the GoJalan Platform, the User must first register a GoJalan Account and obtain approval from GoJalan as a Verified Driver ("Guest").
Approval as a Guest is subject to the User satisfying GoJalan's eligibility requirements and successfully completing all verification procedures required by GoJalan from time to time.
To qualify as a Verified Driver (Guest), the User must:
(a) be at least twenty-three (23) years of age;
(b) hold a valid and current driving licence recognised in Malaysia that authorises the User to operate the class of Vehicle being booked, including:
• a valid Malaysian Competent Driving Licence; or
• a valid foreign or international driving licence recognised under Malaysian law, where applicable;
(c) register a GoJalan Account using:
• a valid email address and password; or
• any other authentication method approved by GoJalan from time to time, including authorised third-party identity or social login services;
(d) provide accurate, complete and current information requested by GoJalan, including identification documents, driving licence details and any additional information or supporting documents reasonably required for identity verification, insurance, operational, security or regulatory purposes; (e) authorise GoJalan, its appointed service providers and participating insurers (where necessary) to conduct identity verification, driving licence verification, fraud prevention checks and any other reasonable background or compliance checks required for the operation of the Platform, subject always to applicable Malaysian laws and GoJalan's Privacy Notice; (f) confirm that the User is medically fit, legally qualified and capable of safely operating a motor vehicle, and is not aware of any physical, medical or mental condition that would materially impair the User's ability to drive safely during the Booking Period; (g) confirm that, to the best of the User's knowledge, the User has not committed any serious driving-related offence involving alcohol, illegal drugs, reckless driving or dangerous driving that would reasonably affect the User's suitability to participate on the Platform. GoJalan may request further information or conduct additional verification where reasonably necessary; (h) comply with the GoJalan Legal Handbook, Community Standards and all applicable Malaysian laws; and (i) satisfy any additional eligibility requirements reasonably specified by the relevant Vehicle Owner (Host) for a particular Vehicle, provided that such requirements:
• are disclosed before the Booking is confirmed;
• are consistent with applicable law and GoJalan's policies; and
• are reasonable, objective and relevant to the safe use of the Vehicle.
GoJalan reserves the right to approve, decline, suspend or revoke a Guest's eligibility where the User no longer satisfies these eligibility requirements or where GoJalan reasonably believes that the User presents an unacceptable safety, insurance, legal or operational risk.
2.2 Continuing Eligibility
A Verified Driver (Guest) must continue to satisfy the eligibility requirements throughout the period of use of the GoJalan Platform.
The Guest must promptly notify GoJalan if:
• the Guest's driving licence expires, is suspended, revoked or otherwise becomes invalid;
• the Guest becomes legally disqualified from driving;
• there is any material change affecting the Guest's ability to operate a Vehicle safely or lawfully; or
• any information previously provided to GoJalan is no longer accurate or complete.
Failure to comply with this Clause may result in the suspension or termination of the Guest's account and may affect the Guest's eligibility to make Bookings or benefit from the protection and insurance arrangements available through the Platform.

Identity Verification To maintain a safe and trusted marketplace, every Guest must successfully complete GoJalan's identity verification process before making a Booking. GoJalan may require one or more verification measures, including:
• identity verification;
• driving licence verification;
• facial recognition or liveness verification;
• payment method verification;
• contact verification; and
• any additional verification reasonably required for fraud prevention, insurance or regulatory compliance.
GoJalan may refuse, suspend or revoke a Guest's verification status if:
• verification cannot be completed satisfactorily;
• false or misleading information is provided;
• the submitted documents appear to be altered, expired or invalid; or
• GoJalan reasonably considers that the account presents an unacceptable operational, legal or security risk.\ -
Guest Responsibilities Throughout every Booking, the Guest shall:
• operate the Vehicle safely, responsibly and in accordance with all applicable laws;
• exercise reasonable care to protect the Vehicle from loss or damage;
• comply with the instructions and reasonable requirements of the Host relating to the use of the Vehicle;
• ensure that only authorised drivers operate the Vehicle;
• return the Vehicle at the agreed time, location and condition;
• promptly report any accident, damage, breakdown or other incident;
• cooperate with GoJalan, the Host and the participating insurer where reasonably required; and
• comply with this Guest Agreement and all applicable Platform policies.
The Guest shall not use the Vehicle for any unlawful purpose or in any manner prohibited by this Handbook, the applicable insurance policy or Malaysian law. -
Booking a Vehicle Guests may browse available Vehicles and submit Booking requests through the GoJalan Platform. A Booking is confirmed only when:
• the Host accepts the Booking, or the Booking is confirmed through the Instant Booking feature;
• the applicable booking payment has been successfully processed;
• the mandatory Peer-to-Peer Motor Insurance arrangement has been completed; and
• any additional verification requested by GoJalan has been successfully completed.
GoJalan may decline, cancel or suspend a Booking where reasonably necessary to:
• protect the safety of Platform users;
• comply with legal, insurance or regulatory requirements;
• investigate suspected fraud or misuse of the Platform; or
• protect the integrity and proper operation of the GoJalan Platform.\
PART II – GOJALAN PROTECTION & DRIVER RESPONSIBILITY
6. GoJalan Driver Protection Plan
GoJalan is committed to providing a safe, transparent and responsible peer-to-peer vehicle sharing experience.
To support every eligible Booking, GoJalan offers the GoJalan Driver Protection Plan, which is designed to provide operational support and facilitate the protection arrangements available through the GoJalan Platform.
The GoJalan Driver Protection Plan may include:
• secure booking and payment processing;
• identity and driving licence verification;
• digital Booking and trip records;
• pre-trip and post-trip Vehicle inspection records;
• claims administration support;
• customer support services;
• emergency roadside assistance coordination (where applicable); and
• other trust and safety measures introduced by GoJalan from time to time.
The GoJalan Driver Protection Plan is an operational support programme and is not an insurance policy.
- GoJalan Super Collision Damage Waiver (GoJalan SCDW) To provide Guests with options to reduce their financial exposure arising from accidental loss of or damage to a Vehicle during an eligible Booking, GoJalan offers one or more GoJalan Super Collision Damage Waiver ("GoJalan SCDW") plans through the GoJalan Platform.
7.1 Mandatory Selection of a GoJalan SCDW Plan Before confirming a Booking, the Guest must review, select and subscribe to one (1) of the available GoJalan SCDW plans offered for the relevant Booking. A Booking cannot be confirmed unless the Guest has selected and subscribed to one (1) available GoJalan SCDW plan. The level of protection available during the Booking depends on the GoJalan SCDW plan selected and subscribed to by the Guest.
7.2 Information Available Before Booking
Before confirming a Booking, the GoJalan Platform will display the relevant information relating to each available GoJalan SCDW plan, including:
• the available GoJalan SCDW plans;
• the applicable subscription fee;
• the principal benefits;
• any applicable excess or deductible;
• the principal exclusions and limitations;
• claim procedures (where applicable); and
• any other material terms applicable to the selected GoJalan SCDW plan.
The Guest is responsible for reviewing the available GoJalan SCDW plans and selecting the plan that best suits the intended Booking.
7.3 Scope of GoJalan SCDW
Subject to the specific plan displayed on the GoJalan Platform at the time of Booking, the selected GoJalan SCDW may apply to:
• accidental damage to the Vehicle's exterior;
• damage to third-party property;
• theft of the Vehicle;
• other accidental loss of or damage to the Vehicle;
• loss or damage caused by fire, theft or an attempted theft;
• a broken windscreen; and
• towing after an accident, up to the maximum amount displayed for the selected plan, for transport to the nearest appropriate repairer.
Unless the selected plan expressly states otherwise, the GoJalan SCDW does not apply to:
• misfuelling or use of an incorrect fuel;
• lost or damaged keys or access devices;
• loss or damage arising from the Guest's negligence or breach of this Guest Agreement, to the extent excluded by the selected plan;
• loss or damage caused by an unauthorised driver;
• damage to the Vehicle's interior;
• any loss, damage, cost or liability outside the stated scope or limit of the selected plan; or
• loss or damage caused by an Act of God or natural catastrophe.
If there is any inconsistency, the material terms displayed for the selected GoJalan SCDW plan before Booking confirmation will apply, subject to this Handbook and applicable law.
7.4 Application of the Selected GoJalan SCDW The GoJalan SCDW selected and subscribed to by the Guest applies only to the relevant Booking and remains subject to: (a) this Guest Agreement; (b) the GoJalan Legal Handbook; and (c) the terms and conditions governing the selected GoJalan SCDW plan.
7.5 Nature of the GoJalan SCDW The GoJalan SCDW: (a) is not an insurance policy; (b) applies only to the Booking for which it was selected and subscribed to by the Guest; (c) is subject to this Guest Agreement, the GoJalan Legal Handbook and the terms of the selected GoJalan SCDW plan; and (d) does not guarantee that every loss, damage or liability will be waived or reimbursed.
7.6 Platform Reference
The available GoJalan SCDW plans, together with the applicable subscription fees, principal benefits, excess amounts, exclusions and other material terms, shall be displayed on the GoJalan Platform at the time of Booking.
The available GoJalan SCDW plans may vary depending on the Vehicle, Vehicle category or other operational requirements.
GoJalan may introduce, amend, replace or discontinue GoJalan SCDW plans from time to time.
Any changes shall apply only to future Bookings and shall not affect an existing confirmed Booking unless otherwise required by applicable law.
By confirming a Booking, the Guest acknowledges that:
• the available GoJalan SCDW plans were presented on the GoJalan Platform before the Booking was confirmed;
• the Guest had sufficient opportunity to review the available plans and their principal terms; and
• the Guest voluntarily selected and subscribed to one (1) GoJalan SCDW plan for the Booking.
- Driver Responsibility & Liability GoJalan recognises that accidents may occur despite a Guest exercising reasonable care. The GoJalan SCDW is intended to provide protection for responsible Guests who comply with this Guest Agreement and the applicable terms of the selected GoJalan SCDW plan.
8.1 Primary Financial Responsibility The Guest is primarily responsible for all Charges, damage, loss and other liabilities arising from the Guest's use of the Vehicle, a Booking or any breach of this Handbook, subject to the selected GoJalan SCDW plan, applicable insurance and non-excludable law.
The Guest may use personal insurance or any other lawful funding source to discharge that responsibility. The availability or use of such a funding source does not release the Guest from liability, and the Guest remains responsible for any excess, exclusion, shortfall or unpaid amount.
8.2 Responsible Use
A Guest who:
• complies with this Guest Agreement;
• drives safely and lawfully;
• complies with the selected GoJalan SCDW plan; and
• cooperates with the Host, GoJalan and the relevant authorities where reasonably required,
may enjoy the protection available under the selected GoJalan SCDW plan, subject to its applicable terms and conditions.
8.3 Negligence
Where loss, damage or additional expense arises from the Guest's negligent act or omission, the Guest's financial responsibility shall be determined in accordance with:
• the selected GoJalan SCDW plan;
• this Guest Agreement; and
• Schedule A – Fees, Charges & Payment Schedule.
Depending on the circumstances, the Guest may remain responsible for:
• any applicable excess or deductible;
• administrative charges;
• reimbursement obligations;
• recovery costs; and
• any other amounts payable under this Guest Agreement.
Examples of negligent conduct include:
• returning the Vehicle later than the agreed return time;
• failing to properly secure the Vehicle or its keys;
• returning the Vehicle in an excessively dirty condition;
• exceeding the agreed mileage allowance;
• failing to comply with reasonable obligations under this Guest Agreement; or
• any other avoidable act or omission resulting in loss or additional expense.\
8.4 Serious Misconduct
GoJalan adopts a zero-tolerance approach towards serious misconduct.
The protection available under the selected GoJalan SCDW shall automatically cease to apply where any loss, damage, accident or incident arises directly or indirectly from the Guest's serious misconduct.
Serious misconduct includes, but is not limited to:
• driving under the influence of alcohol, illegal drugs or any intoxicating substance;
• permitting an unauthorised person to operate the Vehicle;
• intentionally, wilfully or recklessly damaging the Vehicle;
• using the Vehicle for any unlawful or criminal purpose;
• participating in racing, speed testing, drifting or other prohibited activities;
• deliberately providing false, misleading or fraudulent information relating to a Booking, accident or claim;
• refusing or failing to cooperate with GoJalan, the Host, the police, the participating insurer or any competent authority during an investigation or claim;
• abandoning the Vehicle without reasonable cause;
• intentionally failing to report an accident, theft, loss or damage involving the Vehicle; or
• any other conduct expressly excluded under the selected GoJalan SCDW plan.
Where this Clause applies:
(a) the Guest shall not be entitled to any benefit or protection under the selected GoJalan SCDW in respect of the relevant incident;
(b) the Guest may be held fully responsible for all resulting losses, damages, liabilities, costs and expenses, including but not limited to:
• Vehicle repair or replacement costs;
• towing and recovery charges;
• loss of use or loss of Host earnings;
• administrative charges;
• reimbursement amounts;
• legal fees and debt recovery costs (where recoverable); and
• all other costs recoverable under this Guest Agreement, Schedule A – Fees, Charges & Payment Schedule or applicable law;
(c) GoJalan may immediately suspend or terminate the Guest's Account, reject future Bookings and take any other action reasonably necessary to protect the Platform, the Host or other users; and
(d) any suspension or termination shall be without prejudice to any rights or remedies available to GoJalan, the Vehicle Owner (Host), the participating insurer or any competent authority under this Guest Agreement or applicable law.
- Insurance & Protection Disclaimer The Guest acknowledges and agrees that: (a) GoJalan is a technology platform and an insurance agency, and is not an insurer; (b) the GoJalan Driver Protection Plan and the GoJalan SCDW are not insurance policies; (c) the GoJalan SCDW operates solely in accordance with the applicable terms and conditions of the selected GoJalan SCDW plan; and (d) the Guest remains responsible for complying with this Guest Agreement, the GoJalan Legal Handbook and all applicable laws throughout the Booking.
PART III – BOOKING, VEHICLE COLLECTION & USE 10. Vehicle Collection The Guest shall collect the Vehicle at the agreed date, time and location stated in the confirmed Booking. Before taking possession of the Vehicle, the Guest shall: (a) verify that the Vehicle corresponds with the confirmed Booking; (b) inspect the Vehicle for any visible damage, defects or abnormalities; (c) upload clear photographs of the Vehicle in accordance with GoJalan's check-in requirements; (d) report any pre-existing damage or discrepancies through the GoJalan Platform before commencing the Booking; and (e) ensure that the Vehicle is in a roadworthy condition before driving. Where the Guest fails to report any visible damage before commencing the Booking, GoJalan may treat the Vehicle as having been accepted by the Guest in its recorded condition, subject to any evidence subsequently obtained.
- Guest's Responsibilities During the Booking During the Booking, the Guest shall: (a) operate the Vehicle safely, responsibly and in accordance with all applicable laws; (b) exercise reasonable care in protecting the Vehicle from loss, theft, misuse or damage; (c) comply with any reasonable operating instructions communicated by the Host through the GoJalan Platform; (d) ensure that the Vehicle is used only for lawful purposes; (e) keep the Vehicle locked and reasonably secured whenever it is unattended; (f) use the correct type of fuel or charging method specified for the Vehicle; (g) immediately stop using the Vehicle where it becomes unsafe or unroadworthy and notify the Host and GoJalan as soon as reasonably practicable; and (h) promptly notify GoJalan of any accident, theft, breakdown, warning indicator or incident involving the Vehicle.
11.1 Use of Vehicle Within Malaysia
The GoJalan Platform is intended solely for vehicle sharing within Malaysia.
Unless expressly approved in writing by GoJalan and permitted under the applicable insurance arrangements, the Guest shall not drive, take or permit the Vehicle to be taken outside Malaysia during the Booking.
The Guest acknowledges that unauthorised use of the Vehicle outside Malaysia may:
• affect the protection available under the applicable GoJalan Driver Protection Plan and any applicable insurance arrangements;
• constitute a breach of this Guest Agreement; and
• result in the imposition of additional charges under Schedule A – Fees, Charges & Payment Schedule, suspension or termination of the Guest's Account, or such other action as GoJalan may reasonably consider appropriate under the GoJalan Legal Handbook.

Prohibited Use The Guest shall not, and shall not permit any other person to: (a) operate the Vehicle without being an authorised driver approved through the GoJalan Platform; (b) drive under the influence of alcohol, illegal drugs or any intoxicating substance; (c) forge, alter, obscure or cover the Vehicle's registration plate; (d) use the Vehicle for racing, drifting, speed testing or any competitive event; (e) use the Vehicle to commit or facilitate any unlawful act; (f) sell, pledge, charge, use as collateral or otherwise do anything that infringes or jeopardises the Host's ownership of the Vehicle; (g) use the Vehicle for any unauthorised commercial purpose, including rental, subletting, ride-hailing, delivery or carriage for reward; (h) use the Vehicle to tow or push another vehicle or heavy object, carry loads beyond the manufacturer's limits, or breach any reasonable fair-use policy disclosed by the Host; (i) use the Vehicle for driver training, off-road driving or any activity inconsistent with its intended purpose; (j) tamper with, disable or remove any tracking device, dash camera or safety equipment installed in the Vehicle; (k) smoke or vape inside the Vehicle where prohibited by the Host; (l) sublet, assign or otherwise permit any unauthorized use of the Vehicle; (m) use the Vehicle in any manner that voids or materially prejudices the applicable insurance policy or selected GoJalan SCDW plan; or (n) use the Vehicle in any other manner prohibited by this Guest Agreement, the GoJalan Platform or applicable law. A breach of this Clause may result in additional charges, suspension of the Guest's account, termination of the Booking or any other action permitted under this Guest Agreement.

Additional Drivers Only drivers approved through the GoJalan Platform may operate the Vehicle during the Booking. The Guest shall ensure that every approved additional driver: (a) satisfies GoJalan's eligibility requirements; (b) has been registered and approved before driving the Vehicle; and (c) complies with this Guest Agreement as though that person were the Guest. The Guest remains responsible for the acts and omissions of every approved additional driver during the Booking. Permitting an unregistered or unauthorised driver to operate the Vehicle constitutes a material breach of this Guest Agreement and may result in:
• cancellation of the GoJalan SCDW for the relevant incident;
• applicable charges under Schedule A – Fees, Charges & Payment Schedule;
• suspension or termination of the Guest's account; and
• any other action available under this Guest Agreement. -
Returning the Vehicle The Guest shall return the Vehicle: (a) on or before the agreed return time; (b) at the agreed return location; (c) together with all keys, access devices and accessories provided by the Host; (d) in substantially the same condition as when collected, subject to fair wear and tear; and (e) in accordance with GoJalan's check-out procedures. Before completing the Booking, the Guest shall upload the required post-trip photographs through the GoJalan Platform. Late returns, failure to complete the required check-out procedures or failure to return the Vehicle in accordance with this Clause may result in additional charges under Schedule A – Fees, Charges & Payment Schedule.

Fuel, Charging & Vehicle Cleanliness Unless otherwise specified in the Booking: (a) the Vehicle shall be returned with substantially the same fuel level as at the commencement of the Booking; (b) where the Vehicle is an electric vehicle, it shall be returned with substantially the same battery state of charge; (c) the Guest shall return the Vehicle in a reasonably clean condition; and (d) any fuel replacement costs, charging costs, cleaning charges or related administrative fees shall be payable in accordance with Schedule A – Fees, Charges & Payment Schedule.

Extension of Booking A Guest who wishes to retain the Vehicle beyond the original Booking period shall submit an extension request through the GoJalan Platform before the Booking expires.
An extension shall only take effect upon approval by the Host and confirmation through the GoJalan Platform.
Where an extension is not approved, the Guest shall return the Vehicle at the originally agreed time.
Continued possession or use of the Vehicle without an approved extension may constitute a late return or unauthorised retention of the Vehicle and may result in additional charges or other action under this Guest Agreement.
PART IV – ACCIDENTS, BREAKDOWNS, DAMAGE & CLAIMS 17. Accidents, Breakdowns & Emergencies The safety of all persons shall be the Guest's first priority in the event of an accident, breakdown or emergency. Where an accident, collision, theft, fire, breakdown or any other incident involving the Vehicle occurs during the Booking, the Guest shall: (a) stop the Vehicle as soon as it is safe to do so; (b) take all reasonable steps to prevent further loss or damage; (c) check whether any person requires emergency medical assistance and contact the appropriate emergency services where necessary; (d) notify the police immediately where required under applicable law; (e) notify GoJalan through the GoJalan Platform or customer support as soon as reasonably practicable; (f) notify the Host as soon as reasonably practicable unless otherwise instructed by GoJalan; (g) comply with all reasonable instructions provided by GoJalan, the Host, the police or any competent authority; and (h) preserve all evidence relating to the incident. The Guest shall not admit liability, negotiate any settlement or make any promise or representation on behalf of the Host or GoJalan without prior written authorisation, except where required by law.

Accident Reporting Where an accident or damage occurs during a Booking, the Guest shall submit an incident report through the GoJalan Platform as soon as reasonably practicable. The report should include, where applicable:
• the date, time and location of the incident;
• photographs or videos of the Vehicle and surrounding scene;
• details of any third party involved;
• police report details (if applicable);
• witness information (where available); and
• any other information reasonably requested by GoJalan.
Failure to promptly report an incident may affect the Guest's eligibility to receive the benefits available under the selected GoJalan SCDW plan and may result in additional liability where such failure materially prejudices the handling of the incident or claim. -
Breakdown Assistance Where the Vehicle experiences a mechanical breakdown during the Booking, the Guest shall: (a) stop using the Vehicle where it is unsafe to continue driving; (b) notify GoJalan immediately; (c) follow the reasonable instructions provided by GoJalan or the appointed roadside assistance provider; and (d) not arrange repairs, dismantle or modify the Vehicle without the prior approval of GoJalan or the Host, except where immediate action is reasonably necessary to prevent further damage or ensure personal safety. Where the breakdown is not caused by the Guest's act or omission, the Guest will generally not be responsible for the reasonable cost of roadside assistance or towing.
Where the breakdown is caused by the Guest's negligence, misuse or breach of this Guest Agreement, the Guest may be responsible for the applicable costs in accordance with Schedule A – Fees, Charges & Payment Schedule.

Vehicle Damage The Guest shall immediately notify GoJalan of any damage to the Vehicle occurring during the Booking, regardless of whether the damage appears to be minor. The Guest shall not:
• conceal damage;
• repair or authorise repairs without approval;
• dispose of damaged parts; or
• interfere with any investigation relating to the incident.
GoJalan may request photographs, videos, quotations, repair reports or any other information reasonably required to assess the incident. -
Lost, Stolen, Missing or Abandoned Vehicles If the Vehicle is lost, stolen or otherwise missing during a Booking, the Guest shall immediately notify GoJalan and the Host, comply with all reasonable instructions, and cooperate in making a police report as soon as practicable and, unless impossible or directed otherwise by the police, within four (4) hours after discovering that the Vehicle is missing.
The Guest shall cooperate fully and in good faith with GoJalan, the Host, the police, the participating insurer and any competent authority, including by providing truthful information, documents, access records, location data and any other reasonably requested assistance.
At the end of the Booking, the Vehicle must be returned directly to the Host at the agreed location or handed over using a documented procedure expressly approved by the Host or GoJalan. Until the approved handover is completed and the Vehicle is available for inspection by the Host or an authorized representative, the Guest remains responsible for its reasonable care and security.
A Vehicle may be treated as missing where it is left unattended on a highway, roadside, at an apartment, or in a public or private parking area without an approved handover, or where it is otherwise not returned in accordance with the confirmed Booking.
An accident, tyre puncture, mechanical failure or other incident does not authorise abandonment. The Guest must remain with and reasonably secure the Vehicle where safe to do so, promptly contact GoJalan and the Host, and follow their reasonable recovery or handover instructions. This obligation does not require the Guest to remain in an unsafe location.
Where an unauthorized abandonment or improper handover causes or materially contributes to loss, damage or recovery expense, the Guest may be charged the applicable full excess or deductible together with reasonable recovery, storage and related costs, subject to the selected GoJalan SCDW plan and applicable law.
The Host or GoJalan may report the Vehicle as stolen or unlawfully retained to the police where there are reasonable grounds to do so, including where the Guest:
• fails to return the Vehicle at the agreed time and location;
• retains the Vehicle after the Booking expires without obtaining an extension through the GoJalan Platform;
• returns or leaves the Vehicle at an unauthorised location;
• misrepresents or withholds a material fact relating to the Booking, use or operation of the Vehicle;
• leaves the Vehicle unlocked, running or unattended with keys or access devices unsecured, and the Vehicle or its equipment is lost, stolen or damaged;
• fails or refuses to communicate or cooperate in good faith with the Host, GoJalan, the police or another competent authority; or
• permits the Vehicle to be operated by a person using false identity or licence information, an invalid licence or keys obtained without the Host's permission.
Such conduct may constitute a material breach, may cause the selected GoJalan SCDW to cease to apply in accordance with its terms, and may expose the Guest and any responsible driver to applicable civil or criminal consequences.

Guest's Duty to Cooperate The Guest shall cooperate fully and in good faith with GoJalan, the Host, the participating insurer, the police and any competent authority in connection with any accident, investigation, insurance claim or dispute arising from the Booking. Such cooperation includes, where reasonably required:
• providing accurate information;
• attending interviews or meetings;
• signing documents;
• providing witness statements;
• producing relevant photographs, videos or records; and
• assisting in the investigation or resolution of any claim.
Failure to cooperate without reasonable justification may result in:
• suspension of the Guest's Account;
• rejection or reduction of benefits available under the selected GoJalan SCDW plan where permitted under its terms;
• additional liability arising from any prejudice caused to the investigation or claims process; and
• any other action permitted under this Guest Agreement. -
Claims Administration GoJalan may assist the Host, the Guest and the participating insurer in administering claims arising from a Booking.
The Guest acknowledges that GoJalan's role in claims administration is limited to facilitating communication, collecting relevant information and coordinating the claims process.
GoJalan does not determine:
• liability for an incident;
• entitlement under any insurance arrangement;
• entitlement under the selected GoJalan SCDW plan; or
• the amount payable in respect of any claim.
All decisions relating to insurance claims remain subject to the applicable insurance arrangements and the relevant terms governing the selected GoJalan SCDW plan.
- Preservation of Rights Nothing in this Part limits the rights of GoJalan, the Host, the participating insurer or the Guest under this Guest Agreement, Schedule A – Fees, Charges & Payment Schedule, the selected GoJalan SCDW plan or applicable Malaysian law.
PART V – PAYMENTS, ENFORCEMENT & GENERAL PROVISIONS
25. Booking Payments
The Guest agrees to pay all amounts applicable to a confirmed Booking through the GoJalan Platform.
Before a Booking is confirmed, the GoJalan Platform will display a summary of the amount payable, which may include:
• the Booking fee;
• the subscription fee for the selected GoJalan Super Collision Damage Waiver ("GoJalan SCDW") plan; and
• any other amount clearly identified as payable before the Booking is confirmed.
Certain additional charges may arise during or after a Booking depending on the circumstances, including where the Guest incurs additional mileage, returns the Vehicle late, requires additional cleaning, consumes additional fuel or battery charge, incurs tolls or summons, or where other charges become payable under this Guest Agreement.
Any such additional charges shall be calculated and applied in accordance with Schedule A – Fees, Charges & Payment Schedule.
The Guest authorises GoJalan to charge the Guest's nominated payment method for all amounts properly payable under this Guest Agreement.
For the avoidance of doubt, Schedule A – Fees, Charges & Payment Schedule forms part of this Guest Agreement and shall be read together with this Clause.

Refunds & Charge Adjustments Any refund, adjustment or reimbursement relating to a Booking shall be administered in accordance with:
• this Guest Agreement;
• Schedule A – Fees, Charges & Payment Schedule;
• the applicable cancellation policy; and
• any applicable GoJalan policy published on the Platform.
Where an amount is incorrectly charged, GoJalan may make an appropriate adjustment or refund after verification. -
Suspension & Termination To maintain a safe and trusted community, GoJalan may suspend, restrict or terminate a Guest's Account where the Guest:
(a) materially breaches this Guest Agreement;
(b) provides false, misleading or fraudulent information;
(c) engages in fraudulent, dishonest or abusive conduct;
(d) poses an unacceptable safety, legal or operational risk;
(e) repeatedly receives substantiated complaints from Hosts;
(f) misuses the GoJalan Platform;
(g) fails to pay any amount properly due to GoJalan; or
(h) engages in conduct that may adversely affect the safety, integrity or reputation of the GoJalan Platform or its users.
Any suspension or termination may be temporary or permanent depending on the nature and seriousness of the circumstances. Suspension or termination does not affect any rights, obligations or liabilities that accrued before the effective date of the suspension or termination. -
Privacy & Personal Data GoJalan respects the privacy of its users and is committed to protecting personal data in accordance with applicable Malaysian laws. GoJalan processes personal data in accordance with its privacy policy ( https://gojalan.my/privacy-policy) , as updated from time to time. The Privacy Policy should be read together with this Handbook. Kindly read and understand our Privacy Policy before providing us with your Personal Data. If you do not agree with our Privacy Policy, kindly refrain from using the Services and accessing the Platform.

GoJalan's Role GoJalan is committed to providing a trusted, safe and seamless peer-to-peer vehicle sharing experience for both Vehicle Owners (Hosts) and Verified Drivers (Guests). As the operator of the GoJalan Platform, GoJalan facilitates the connection between Hosts and Guests and supports the vehicle sharing journey through services that may include:
• account registration and identity verification;
• booking management and secure payment processing;
• access to GoJalan Super Collision Damage Waiver ("GoJalan SCDW") plans;
• customer support and operational assistance;
• claims administration support;
• trust and safety initiatives; and
• other Platform services introduced from time to time to enhance the GoJalan experience.
Every Vehicle listed on the GoJalan Platform is independently owned and made available by the respective Vehicle Owner (Host). While GoJalan facilitates the Booking and supports the sharing experience, the Host remains responsible for the Vehicle made available through the Platform.
Nothing in this Guest Agreement shall be construed as creating any partnership, joint venture, employment, agency or fiduciary relationship between GoJalan, the Host and the Guest, except where expressly provided under this Guest Agreement. Nothing in this Guest Agreement excludes or limits any rights or obligations that cannot lawfully be excluded or limited under the laws of Malaysia.
- Amendments GoJalan may amend this Guest Agreement, the GoJalan Legal Handbook or any applicable Platform policies from time to time.
Where a material amendment is made, GoJalan will provide reasonable notice through the GoJalan Platform or by any other appropriate means.
Continued use of the GoJalan Platform after the effective date of the amendment constitutes acceptance of the revised terms.

Governing Law & Dispute Resolution This Guest Agreement shall be governed by and construed in accordance with the laws of Malaysia. The Guest and GoJalan shall first endeavour to resolve any dispute arising out of or in connection with this Guest Agreement through good faith discussions. Where a dispute cannot be resolved amicably, either party may refer the dispute to the courts of Malaysia, which shall have exclusive jurisdiction, unless otherwise required by applicable law.

General Provisions If any provision of this Guest Agreement is held to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect. No failure or delay by GoJalan in exercising any right or remedy under this Guest Agreement shall constitute a waiver of that right or remedy. This Guest Agreement, together with the GoJalan Platform Terms of Use, the GoJalan Legal Handbook, Schedule A – Fees, Charges & Payment Schedule and any other applicable schedules or policies, constitutes the entire agreement between GoJalan and the Guest in relation to the Guest's use of the GoJalan Platform.

Guest Acknowledgement By creating a GoJalan Account, making or confirming a Booking, or using a Vehicle through the GoJalan Platform, the Guest acknowledges and agrees that: (a) the Guest has read, understood and agrees to be bound by this Guest Agreement; (b) the Guest agrees to comply with the GoJalan Legal Handbook and all applicable GoJalan policies; (c) the Guest understands the rights, responsibilities and liabilities arising from the use of the GoJalan Platform; (d) the Guest has reviewed, selected and subscribed to a GoJalan Super Collision Damage Waiver ("GoJalan SCDW") plan before confirming the Booking; (e) the Guest understands that the GoJalan Driver Protection Plan and the GoJalan SCDW are not insurance policies; and (f) the Guest agrees to be legally bound by this Guest Agreement
SCHEDULE A COMMERCIAL SCHEDULE Fees, Charges & Payment Arrangements This Commercial Schedule forms part of the GoJalan Legal Handbook and shall be read together with the GoJalan Platform Terms of Use, the Guest Agreement and the Host Agreement. The fees, charges and payment arrangements set out in this Schedule apply to the use of the GoJalan Platform. Unless otherwise stated, all amounts are in Malaysian Ringgit (RM). GoJalan may amend this Commercial Schedule from time to time by providing reasonable notice through the GoJalan Platform.

A3 Additional Mileage Applicable where the Guest exceeds the included mileage allowance without pre-purchasing additional mileage. • Included mileage: 200 km per day (accumulated basis). • Excess mileage: RM2.00 per km. End of Trip
A4 Cleaning Charge Applicable where the Vehicle requires cleaning beyond normal wear and tear. • Minor cleaning – Minimum RM80. • Major cleaning – Minimum RM300. End of Trip
A5 Fuel / EV Charging Replacement Applicable where the Vehicle is returned with less fuel or battery charge than at handover. Petrol / Diesel: Actual replacement cost plus RM200 administrative charge.Electric Vehicle: RM3.50 per kWh for any reduction below the handover state of charge. Within 48 hours after the Trip
A6 Guest Cancellation Applicable where a confirmed Booking is cancelled by the Guest. • Cancellation within 24 hours before Trip commencement – Up to one (1) day's Booking fee. • Same-day Booking cancelled within 1 hour before Trip commencement – Up to one (1) day's Booking fee. Upon cancellation
A7 Guest No-Show Applicable where the Guest fails to collect the Vehicle within the permitted collection period. Up to one (1) day's Booking fee where the Guest fails to collect the Vehicle within one (1) hour after the scheduled commencement time. Trip commencement
A8 Late Return Applicable where the Vehicle is returned after the agreed return time. • Less than 1 hour – No additional charge. • 1 hour or more – Additional one (1) day's Booking fee. End of Trip
A9 Traffic Summons & Fines Applicable for all traffic offences, parking offences and other fines incurred during the Trip. Actual summons or fine amount plus an administrative handling charge of 35%–100% of the summons amount, depending on the nature, severity and complexity of the administration required. Upon notification
A10 Toll Charges Applicable for toll charges incurred during the Trip. Actual toll charges incurred. End of Trip
A11 Towing & Vehicle Impounding Applicable where towing or recovery services are required. • No charge where the breakdown is not attributable to the Guest. • Where caused by the Guest's act or omission, the Guest shall bear the full towing, recovery and associated costs. GoJalan's determination shall be final for administrative purposes. End of Trip
A12 Failure to Return Vehicle Applicable where the Vehicle is not returned in accordance with the Booking. The Guest shall be responsible for all reasonable recovery, repossession, storage, loss of income, third-party costs, administrative charges and legal recovery costs, where applicable. As incurred
A13 Unauthorised Additional Driver Applicable where an unauthorised person drives the Vehicle during the Trip. RM500 administrative charge. End of Trip
A14 Driving Under the Influence Applicable where the Guest drives the Vehicle while under the influence of alcohol, drugs or other intoxicating substances. RM500 administrative charge, in addition to any applicable summons, fines or other liabilities. End of Trip
A15 Failure to Cooperate with Investigation Applicable where the Guest refuses to cooperate with GoJalan, the police or any competent authority in relation to an incident or accident. RM500 administrative charge. End of Trip
A16 Emergency Roadside Assistance Applicable where roadside assistance is required due to the Guest's act or omission. RM100. End of Trip
A17 Failure to Upload Required Vehicle Photographs Applicable where the Guest fails to upload the required photographs before Vehicle collection and/or upon Vehicle return. RM100 administrative charge. End of Trip
A18 Improper Handover / Vehicle Abandonment Applicable where an unauthorised abandonment or improper handover causes or materially contributes to loss, damage or recovery expense. Applicable full SCDW excess or deductible, plus reasonable recovery, storage and related costs, subject to verification, the selected SCDW plan and applicable law. As incurred after verification

B3 Host Cancellation Applicable where the Host cancels a confirmed Booking. • Less than 48 hours before Trip commencement – Up to one (1) day's Booking fee. • Same-day Booking cancelled within 1 hour before Trip commencement – Up to one (1) day's Booking fee. Upon cancellation
B4 Host No-Show Applicable where the Host fails to hand over the Vehicle for a confirmed Booking. Up to one (1) day's Booking fee. Trip commencement
B5 Misrepresentation Applicable where false or misleading information or documents are submitted by the Host. Minimum RM100, together with reimbursement of any resulting loss suffered by GoJalan. Where applicable
B6 Vehicle Misrepresentation Applicable where the Vehicle listing or supporting documents are inaccurate, misleading or invalid. Minimum RM100, together with reimbursement of any resulting loss suffered by GoJalan. Where applicable
B7 Misreporting Late Guests Applicable where a late Guest is falsely reported. RM100. Where applicable
B8 Cleaning & Vehicle Presentation Applicable where the Vehicle is handed over in an unclean or unsatisfactory condition. Up to RM300. Where applicable
B9 Failure to Maintain Vehicle Applicable where the Host fails to maintain the Vehicle in a safe and roadworthy condition. RM200 per occurrence. Where applicable
B10 Abuse of Reporting Function Applicable where the Host abuses the reporting function on the GoJalan Platform. RM100. Where applicable
B11 Improper Reimbursement Claims Applicable where false or unsupported reimbursement claims are submitted. RM200 per occurrence. Where applicable
PART III – HOST REIMBURSEMENT GUIDE Where a Host submits a reimbursement request through the GoJalan Platform, the following supporting documents shall be provided. Reimbursement Item Supporting Documents Fuel Replacement Pre-trip and post-trip photographs of the fuel gauge and odometer, together with the official fuel receipt or invoice. Pre-authorisation receipts will not be accepted.
Additional Mileage Pre-trip and post-trip photographs of the odometer showing the recorded mileage.
Smoking Violation Clear photographic evidence of cigarette ash, cigarette butts or other evidence of smoking inside the Vehicle.
Cleaning Charges Photographs showing the Vehicle before and after cleaning together with the official cleaning receipt or invoice.
Traffic Summons & Fines Copy of the summons or fine together with proof of payment.
Toll Charges Toll receipt or other satisfactory evidence showing the date, time and amount incurred.
Late Return Time-stamped photographs or other satisfactory evidence confirming the actual Vehicle return time.
Late Return Reimbursement Delay Host Reimbursement Within 2 hours 40% of one (1) day's Booking fee
More than 2 hours but within 6 hours 75% of one (1) day's Booking fee
More than 6 hours 100% of one (1) day's Booking fee
Host reimbursements shall be subject to the applicable Marketplace Fee.
PART IV – PAYMENT ARRANGEMENTS
- All payments relating to Bookings shall be processed through the GoJalan Platform using the payment methods approved by GoJalan.
- GoJalan may deduct any fees, charges, refunds or other amounts properly payable under the GoJalan Legal Handbook from any payment otherwise due to a Guest or Host, where permitted by applicable law.
- Any outstanding amount shall remain payable until fully settled.
- Unless otherwise stated, all fees and charges are inclusive of any applicable taxes.
